Welcome to Landscapers Southwark. These Terms and Conditions govern your use of our landscaping services. By engaging our services, you agree to abide by the following terms. Please read them carefully.

1. Definitions

Client: The individual or entity engaging our landscaping services.

Services: All landscaping activities performed by Landscapers Southwark, including design, installation, maintenance, and consultation.

Agreement: The contractual relationship between the Client and Landscapers Southwark as outlined by these Terms and Conditions.

2. Services Provided

Landscapers Southwark offers a wide range of landscaping services tailored to meet the unique needs of our clients in the Southwark area. Our services include, but are not limited to:

Design and Planning: Creating customized landscaping plans that suit your property and preferences.
Installation: Implementing the approved design, including planting, hardscaping, and other installations.
Maintenance: Ongoing care to ensure the longevity and beauty of your landscape.
Consultation: Providing expert advice on landscaping choices and care.

3. Pricing and Payment Terms

All services are priced based on the scope and complexity of the project. Upon agreement, a detailed quote will be provided. The payment terms are as follows:

Deposit: A non-refundable deposit of 30% of the total project cost is required to commence work.
Progress Payments: Payments will be scheduled based on project milestones as outlined in the contract.
Final Payment: The remaining balance is due upon completion of the project.

Payments can be made via bank transfer, credit card, or other agreed-upon methods. Late payments may incur additional fees.

4. Scheduling and Cancellations

We strive to accommodate your scheduling preferences. However, timelines are subject to weather conditions and other unforeseen circumstances. In the event of delays, we will communicate promptly to adjust schedules as needed.

Cancellation by Client: If you need to cancel or reschedule a service, please provide at least 48 hours notice. Cancellations made with less notice may still require the deposit.
Cancellation by Landscapers Southwark: We reserve the right to cancel services due to reasons beyond our control. In such cases, any deposits paid will be refunded.

5. Client Responsibilities

To ensure the success of your landscaping project, the Client agrees to:

Provide accurate information about the property and any preferences or requirements.
Ensure access to the property during scheduled service times.
Obtain any necessary permissions or permits required for the project.
Communicate any changes or concerns promptly.

6. Liability

Landscapers Southwark strives to perform all services with the highest level of professionalism and care. However:

We are not liable for any pre-existing conditions on the property that may affect the project.
Clients are responsible for ensuring that all necessary permits and permissions are obtained.
We are insured for liability and will cover any direct damages caused by our negligence during the project.
We are not responsible for indirect or consequential damages arising from the use of our services.

7. Changes to Terms

Landscapers Southwark reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in the UK.

9. Dispute Resolution

In the event of a disagreement, both parties agree to attempt to resolve the issue through informal negotiation. If a resolution cannot be reached, the dispute may be escalated to mediation or arbitration as agreed upon by both parties.

10. Termination

Either party may terminate the Agreement under the following conditions:

Material breach of the Agreement by the other party.
Insolvency or bankruptcy of either party.
Mutual agreement to terminate the Agreement.

Upon termination, the Client is responsible for paying for all services rendered up to the termination date.

11. Intellectual Property

All designs, plans, and documentation produced by Landscapers Southwark remain the intellectual property of the company unless otherwise agreed in writing. Clients are granted a non-exclusive license to use the materials for their intended purpose.

12. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the course of the Agreement. This obligation remains in effect even after the termination of the Agreement.

13. Force Majeure

Landscapers Southwark is not liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, or other unforeseeable events.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Client and Landscapers Southwark, superseding all prior agreements or understandings, whether written or oral.

By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
